Terms of Use

These Terms of Service (hereinafter referred to as the "Terms") define the conditions for the provision and use of services offered by Photo-Mix.online (hereinafter referred to as the "Service").

 

1. Services

 

1.1. The Service provides automatic photo creation services intended for official documents (hereinafter referred to as the "Services"). This includes:

  • uploading an image by the user,
  • automatic face cropping,
  • background removal,
  • resizing to meet standard requirements (e.g., 35×45 mm),
  • generating a final digital file with a white background, compliant with the requirements of official institutions in Poland and other EU countries.

1.2. The result of the Service is a digital photo intended for documents, including official ones. The user receives a downloadable JPG file prepared in 10×15 cm print format, containing one or more photos based on the uploaded image. The user does not receive a physical copy of the photo, only a digital file suitable for further use in print or online.

1.3. The result of the Service is available to the client immediately after payment, but no later than within one (1) business day. The download link is active for 14 (fourteen) days from the time of payment.

1.4. The Services are available for personal use only.

1.5. All materials uploaded by the user are deleted after 14 (fourteen) days and are not reused.

 

2. Registration and Access

 

2.1. Registration is not required to use the Services of the Service.

2.2. Access to the Service may be restricted or suspended in case of violation of these Terms.

 

3. User Obligations

 

3.1. The user undertakes to use the Service in accordance with the applicable laws of the Republic of Poland, European Union regulations, international law standards, and the provisions of these Terms. This includes, among others, data protection (GDPR), copyright law, online communication ethics, and general rules of fair digital interaction.

3.2. The user is fully responsible for the content of the uploaded materials, including photos, portraits, logos, graphics, etc. By uploading materials, the user confirms that they have all rights to use them.

3.3. It is prohibited to upload materials that:

  • infringe copyright or other third-party rights (including image rights, trademarks, etc.),
  • contain illegal, harmful, vulgar, offensive, discriminatory, or otherwise unethical content,
  • include elements of pornography, violence, or any form of hate toward individuals or groups,
  • can be interpreted as fraud attempts, document forgery, or disturbance of public order,
  • are AI-generated or intended to mislead.

3.4. In the event of a violation of the principles set out in this section, the Service Administration reserves the right to immediately suspend or restrict the User's access to the Services without prior notice and, if necessary, to refer the matter to the appropriate authorities.

 

4. Service Liability

 

4.1. The Service is not liable for:

  • further use of photos obtained via the Service;

  • incorrect or incomplete information provided by the user;

     

4.2. The Service guarantees deletion of all uploaded materials after 14 days from their upload.

 

5. Payments

 

5.1. Services on the Service are paid. The price of the Services is provided on the homepage and in the order form.

5.2. Payments are processed via the PayU system (https://payu.com).

 

6. Refunds

6.1. According to the applicable laws of the Republic of Poland and the European Union, digital products without physical form (e.g., electronic photos) are non-refundable after the order is completed, unless stated otherwise in the Terms.

The basis is Article 38(13) of the Consumer Rights Act of May 30, 2014, which states that the right of withdrawal is lost when the delivery of digital content begins before the withdrawal period ends — with the explicit consent of the consumer.

6.2. In the case of significant defects in the final file that prevent its intended use (e.g., for official institutions), the customer has the right to submit a complaint.

6.3. Complaints must be submitted within 14 calendar days of payment and file receipt via the contact form on the website Contact Form or by email to [email protected]

6.4. A complaint should include:

  • a brief description of the issue;
  • the file received from the Service;
  • (if available) an official comment or letter from the institution rejecting the photo.

6.5. Complaints are reviewed within 3 business days from receipt. A response will be sent to the email provided in the submission.

 

7. Intellectual Property

 

7.1. The user is not entitled to use the Service’s materials without prior written consent.

 

8. Data Protection

 

8.1. The use of the Service is subject to the Privacy Policy available at Privacy Policy

10. Changes to the Terms

 

10.1. The Service Administration reserves the right to change these Terms at any time.

10.2. The updated version of the Terms will be published on the website, along with the effective date of the changes.
